Terms of Service

The agreement behind every package and monthly plan, written in plain English. Please read it before you buy.

Effective date: October 11, 2026

These terms are the agreement between you (the business buying from us) and Evenhand (“we,” “us,” “our”). They cover buying a website package, a monthly plan, or an SEO and AI-search audit from evenhandsites.com.

We wrote them in plain English on purpose. If anything is unclear, email hello@evenhandsites.com before you buy.

By checking the terms box at checkout, or by paying for a package or plan, you agree to these terms. If you are buying for a business, you confirm you are allowed to agree on its behalf and that you are at least 18.

1. What you are buying

We sell three one-time website packages, three optional monthly plans, and a one-time SEO and AI-search audit. The pricing page on evenhandsites.com lists exactly what each one includes. Those lists are part of these terms.

Package Price Revisions included
Starter $250 1
Business $500 1
Enterprise $1,000 3
Monthly plan Price
Maintenance $99 per month
Priority Maintenance $129 per month
Monthly analytics report $49 per month

Some things to know about the packages and plans:

  • Every package is custom-designed for your business. We do not resell website templates.
  • Website redesign. A redesign is priced as a new website: you pay the price of the package you choose. We build your new site from scratch, keep the parts of your old site you want (for example your logo, photos, text and colors), move over the content you want to keep, and point your old page addresses to the new ones so existing links keep working.
  • Accessibility. We aim to build every package to meet the WCAG 2.1 Level AA accessibility standard at launch, for the pages and features we build. Third-party tools and services (for example checkouts, booking tools, maps and embedded stores), and content or features added after launch by you or anyone else, are outside that aim. Every site is checked against our own checklist, the Evenhand Standard (below). Enterprise also includes a written accessibility statement for your site and a report of our accessibility checks. We do not give legal advice about whether any particular law applies to your business. Content or features you (or anyone else) add after launch can affect accessibility.
  • Search features (SEO and GEO). Where a package includes search work, including Enterprise’s Google Business Profile optimization, we do the work to a professional standard. No one can promise a specific search ranking, and we do not.
  • Pages. The Starter package includes up to 8 pages, the Business package up to 25, and the Enterprise package every page your business needs. On the Enterprise package, “every page your business needs” means the pages we agree with you in writing when your intake is complete, made from your own services, locations and content: for example, a page for each service and each location you list, plus your home, about and contact pages and the policy pages. During your revisions, you can ask for more pages, and we add them as part of those revisions. After your site launches, a new page is a change request: we quote it separately before any work starts. A page is one web address with its own content, like your home page or your services page. Legal pages, the not-found and thank-you pages, and the page of each item in your shop don’t count. Each blog or guide post counts as a page, except the weekly posts that come with the Priority Maintenance plan. If your site needs more pages than your package includes, you can upgrade to the next package: you pay the difference in price between the two packages (section 6).
  • Selling on your site. Every package can sell on your site, with a checkout run by Stripe in your own Stripe account, or by Square in your own Square account if you already sell with Square. If you already run a Shopify store, we connect it to your site instead, whatever its size. On the Starter package, your site’s own pages show up to 5 of its products, styled to match your site, and on the Business package up to 25; for the rest, they link to your store. Restyling your Shopify store’s own pages to match your site is part of the Enterprise package. Payments go to you, the payment company’s fees are yours, and we never see or handle card details. On every package, an item counts once, with all its sizes, colors and other options.
    • Starter: up to 5 items, with options like size. Each item is a physical good, whose options may have different prices, or a gift voucher or gift card (below). A Starter site never sells deposits, digital downloads, subscriptions, tickets, made-to-order items a customer configures, or anything age-restricted.
    • Business: up to 25 items, with options like size.
    • Enterprise: up to 50 items, or we connect and style your Shopify or Square store, whatever its size.
    • What a Business or Enterprise site sells: physical goods, with options like size or color, and gift vouchers or gift cards (below). It never sells subscriptions, tickets, digital downloads, deposits, or anything age-restricted, except on the Enterprise package through your own Shopify or Square store.
    • Gift vouchers and gift cards: with Stripe, a gift voucher is a code for a fixed amount that you create in your own Stripe account. It can be used once, and it keeps no remaining balance. If you sell with Square, your site can sell Square gift cards instead, which keep a balance, under Square’s own terms.
    • Sales tax on your sales: you choose at intake how your checkout handles sales tax: Stripe Tax (Stripe charges its own fee for each order, and you must be registered where you collect tax), a fixed rate you give us, or none. That choice is yours. Which taxes apply to your sales, and collecting and paying them, are your responsibility. We do not decide your tax, and nothing we say about it is tax advice.
    • More items: if you want to sell more items than your package includes, you can upgrade to the next package: you pay the difference in price between the two packages (section 6). With a connected Shopify store, every product stays for sale in your store: the limit is only on how many of them your site’s own pages show. Beyond the Enterprise package’s 50 items, we connect and style your own Shopify or Square store.
  • Google Business Profile optimization (Enterprise). It is optional and included in the Enterprise package. If you want it, we do it at launch, once you add us as a manager of your Google Business Profile. Because it depends on you, it is not part of the 3 to 10 day delivery or of our delivery guarantee (section 4). You keep ownership of your profile.
  • A privacy policy page (every package). Every site we build includes a privacy policy page. We make it from a public template: the Basecamp open-source policies (github.com/basecamp/policies), which their authors share under the Creative Commons Attribution 4.0 license (CC BY 4.0). Your page names that source at its end. The page is a template. It is NOT LEGAL ADVICE. We do not check whether it fits your business or meets the laws that apply to you. Have it reviewed by your own attorney and changed as they advise; we remind you at handoff. You are responsible for your privacy policy, and we are not liable for its content.
  • Maintenance plan ($99 per month). For sites we built; if we did not build your site, email us for a quote. It covers: hosting your site; security and software updates; uptime monitoring; a monthly automated accessibility and speed check, with a note to you on what it finds; up to 2 small edits a month (for example, swapping text or a photo); and replies to your requests within 3 business days. New pages, new features and redesigns are not small edits; we quote them separately before any work starts.
  • Priority Maintenance plan ($129 per month). For sites we built. It covers everything the Maintenance plan covers, with four differences: up to 5 small edits a month instead of 2; replies to your requests within 1 business day; your requests are answered before Maintenance plan requests; and a new blog or guide post on your site every week. New pages, new features and redesigns are not small edits; we quote them separately before any work starts.
  • The weekly post (Priority Maintenance). We write each post from real facts about your business and email it to you before it goes live. It goes live 3 business days after we send it, unless you tell us not to. If you do, we hold it, and then we revise it with you or drop it. No one can promise how a post ranks or what AI tools will say about it, and we do not.
  • Switching between Maintenance and Priority Maintenance. You can switch at any time. A switch up to Priority Maintenance starts right away, and you pay the difference between the two prices for the rest of the month you have already paid for. A switch down to Maintenance starts with your next monthly payment; until then you keep Priority Maintenance.
  • The Business and Enterprise packages include your first month of Maintenance at no charge. That is the Maintenance plan, not Priority Maintenance.
  • Monthly analytics report ($49 per month). Available for any website, whether or not we built it. It needs read access to your website’s analytics accounts. The report covers your website’s own analytics only: your hosting platform’s analytics, Google Search Console, Bing Webmaster Tools, Google Analytics 4, and Shopify (if you use it). It explains what the numbers show. It is not business, marketing, legal, or financial advice.

The Evenhand Standard

The Evenhand Standard is our own internal checklist for the websites we build. It is not a certification by anyone else.

  • What it checks. The layout on phones, tablets and laptops; links and forms; page speed; search basics (page titles, descriptions and structured data); and accessibility basics, like contrast, keyboard use and image descriptions.
  • Its aim for accessibility. For accessibility, its aim is the WCAG 2.1 Level AA accessibility standard at launch, for the pages and features we build.
  • How we check. We use automated tools, and before delivery a real person at Evenhand looks over every site. Automated tools catch only some problems, so a site can pass them and still have one.
  • What it does not cover. Third-party tools and services (for example checkouts, booking tools, maps and embedded stores), and content or features added after launch by you or anyone else, are outside it.
  • What you get in writing. The Enterprise package includes a written accessibility statement for your site and a report of the accessibility checks we ran on it.

SEO and AI-search audit

  • What it is. The audit costs $250, paid once, and covers one website. You get a report as a slide deck of up to 24 slides: the problems we find, ranked by how much we expect each to matter, a fix for each, what your competitors do, and a suggested timeline.
  • Also included. An AI-search check (what ChatGPT, Perplexity and Google’s AI Overviews say about your business when we check, and what is missing or wrong; their answers can change over time); copy-paste fixes (ready-made code for your site’s structured data, page titles and meta descriptions, for you or your developer to add); and links to our free, public step-by-step guides for setting up Google Search Console, Bing Webmaster Tools, Google Analytics 4, Google Business Profile, Bing Places for Business and Apple Business (formerly Apple Business Connect).
  • What the audit does not do. The audit is a report. We work from the outside, with what anyone can see online. We do not need your logins, and we do not change anything on your website as part of the audit.
  • Delivery. We email your audit report within 5 business days of your purchase.
  • 30-day follow-up. About 30 days after we deliver your audit, we check your website once more and email you what changed and what is still open. This one follow-up check is included in the audit price. It is based on your public web pages, plus any read-only access (for example to Google Analytics or Google Search Console) that you choose to give us.
  • Website discount. If you buy a website package within 30 days after we deliver your audit, we take 20% off that package’s price. It applies to any of our three website packages. The discount is used once, on one website package, by the business that bought the audit. It is not paid out in cash and does not apply to monthly plans. To use it, email us before you check out and we will send you a checkout link with the discount applied. A website package you buy for the same website after an audit is built with the website fixes from your audit report that the package covers.
  • Fix work is a separate purchase. If you want us to make the fixes on your current website, and your platform lets you add us as a user, we send you one fixed price, in writing, before any work starts, for the fixes in your audit report that we can make there. The quote shows the price of each fix. If those prices add up to less than our minimum order, it also shows a minimum-order line for the difference. We never bill fix work by the hour. We never ask for your password. If a fix turns out to be bigger than we quoted, we stop and send you a new fixed price for it before doing more.
  • No ranking promises. The audit tells you what we find and what to fix. No one can promise a specific search ranking or what AI tools will say about your business, and we do not.

We may change our prices or package contents in the future. A change never affects a package, audit or month you have already paid for.

2. Payment

  • Packages are paid in full, up front, at checkout. We start work after payment clears.
  • Monthly plans are billed in advance each month on the same day of the month you signed up, and renew automatically until you cancel. Our Refund and Cancellation Policy explains how to cancel.
  • Extra revisions are $50 each, paid before we start that revision.
  • Payments are processed by Stripe. We never see or store your full card number.
  • Prices are in U.S. dollars and do not include any tax that may apply.

Refunds and cancellations are covered in our separate Refund and Cancellation Policy, which is part of these terms.

3. How a project works

  1. You pick a package and pay.
  2. You fill out our intake form and send us your content: your logo, photos, and anything else the site should show. By default, we write your page text from your intake answers and you approve it. If you would rather write it yourself, or you already have text, tell us on the intake form and we will shape it to fit the design.
  3. We design and build your site and send you a private preview link to review.
  4. You request changes using your included revisions (see section 6).
  5. Once you approve the launch in writing, we launch your site on your domain and hand it over with a plain-English owner’s guide, your Ownership Certificate (section 7) and a short recorded walkthrough video. Enterprise also includes a live walkthrough call.

Timing. We deliver your site for your review in 3 to 10 days, backed by our delivery guarantee in section 4. Enterprise projects start first in our queue.

Launch is your decision. You are responsible for deciding when your site launches. We launch it only after you approve the launch in writing (an email is enough), on a day we agree with you.

If a project goes quiet. If we have not heard from you for 60 days after we ask for something we need, we may close the project. Before we do, we will email you at least twice. If we close it, we will hand over whatever work is finished at that point, and no refund is owed beyond what our Refund and Cancellation Policy says.

4. Our delivery guarantee

Your site is delivered for your review in 3 to 10 days, or it’s free. Here is exactly how it works.

  • What “delivered” means. We send you your complete, working site on its private preview link. Revisions, domain access, and launch day come after delivery and are not part of the deadline. “Delivered for your review” means delivered this way: we email the link to your site’s private preview to the email address you gave us for your project, and delivery is made at the time our email system records sending it. Checking that inbox, including its spam or junk folder, is your part.
  • If that email address does not work. If the address you gave us bounces or is not working when we send, the delivery still counts as made at the time we sent it. We then call you, or use the other contact details you gave us, to get a working address, and we send the link again as soon as we can.
  • When the clock starts. The clock starts when you have submitted your intake form and we have received the information it asks for (for example your logo, photos, and answers). That means your intake form is complete and we have every piece of information the build of your site needs. If something is missing, we will tell you what it is, and the clock starts once it arrives.
  • Who decides that it is complete. We do. We check your intake form within 1 business day after we receive it. If anything the build needs is missing, we email you within that time to say what it is. If we do not, your intake counts as complete at the time you submitted it.
  • The deadline. 240 hours (10 days of 24 hours, counted to the second) after the clock starts. Delivering sooner, even before day 3, is fine. We count in Pacific time, from the time our systems record receiving your intake form or, if something was missing, the last missing piece (by email or upload).
  • Calendar days. The 3 to 10 days are calendar days, not business days: weekends and holidays count. The clock does not stop for a weekend or a holiday.
  • If we are waiting on you. The clock does not stop once it has started. If we need something from you and do not have it, we finish your site with our best choice in its place, mark that spot so you can see it, and deliver on time. Your answer then goes in as one of your included revisions.
  • If we miss it. If we have not delivered by the deadline, we refund 100% of the package price you paid ($250, $500, or $1,000), and we still finish your site and hand it over to you. The refund is paid as our Refund and Cancellation Policy describes.
  • What it covers. The guarantee covers the three website packages, including a redesign bought as one of them. Monthly plans (Maintenance, Priority Maintenance and the Monthly analytics report) and the SEO and AI-search audit are not part of it; the audit has its own delivery time (section 1). Neither is the optional Google Business Profile work in the Enterprise package, which we do at launch (section 1).

5. What we need from you

You are responsible for:

  • Your content. Giving us the images, logos, prices, hours, and other information for your site (and any text you choose to write yourself), on time.
  • Accuracy. Making sure everything you give us is true and up to date. We build what you give us; we do not fact-check your business claims, prices, licenses, or credentials.
  • Rights to what you supply. You confirm you own, or have permission to use, everything you send us (photos, logos, text, trademarks, reviews). If someone claims your material infringes their rights, that is your responsibility, not ours.
  • Legal requirements that are specific to your business. For example, license numbers, industry disclosures, or rules about advertising your services. We can place them on the site; you must tell us what they are.
  • Timely review. Reviewing drafts and answering questions so the project can keep moving.
  • Access. Giving us access to the accounts we need (for example your domain registrar or booking tool). Where a service lets you invite us as a user, please do that instead of sending us your password. We will never ask for your password by email.

Medical and health providers. The sites we build never collect protected health information (PHI): no patient intake forms, no health questions in contact forms, and no patient chat. Visitors contact you by phone or through links to your own systems. Please do not send us any patient information at any time.

6. Revisions

  • What a revision is. One revision is one list of changes, sent together: you send us one list, and we make the changes. A list can include redesigning parts of your site or adding new pages, up to your package’s page limit (section 1).
  • Included revisions: Starter 1, Business 1, Enterprise 3.
  • Extra revisions: $50 each.
  • Fixing our mistakes is free. If something does not match what we agreed, or does not work as it should, fixing it does not use up a revision.
  • Revision window. Included revisions must be used within 30 days after launch.
  • Upgrades. A feature that belongs to a bigger package (for example, online booking on a Starter site), or more pages or shop items than your package includes, is an upgrade, not a revision: you pay the difference in price between the two packages. We will confirm it in writing before we start.

7. Who owns the finished site

Once your package is paid in full and your site is launched or handed over to you, you own your finished website and everything in it, including all of its code, the design we made for you, and the written content we wrote for you. There is no handoff fee. Our general tools, internal systems, processes, and know-how (the things we use to do the work, which are not part of your site) stay ours.

Everything you gave us (your text, photos, logo, and brand) was always yours and stays yours.

In writing. Our checkout asks you to accept these terms and records that you did, with the date and time. At handoff, we also give you a one-page Ownership Certificate, signed electronically by you and by us. It confirms in writing that you own your site as this section describes. The third-party parts below stay under their own licenses.

Third-party parts. Your site may use open-source software, fonts, icons, or stock images that belong to others. Those stay under their own licenses. We aim to choose ones whose licenses allow commercial use on your site.

How we build. We use modern software tools, including AI-assisted tools, as part of how we design and build. Before delivery, every site is checked against the Evenhand Standard and looked over by a real person at Evenhand.

Our credit and portfolio. We may show your finished site in our portfolio and marketing unless you tell us not to. We may also place a small “Site by Evenhand” credit in your site’s footer, which we will remove if you ask.

8. Hosting and domains

  • Hosting. We host every site we build on our own hosting account.
    • Maintenance plan: while you have Maintenance (or Priority Maintenance), hosting is included.
    • Without Maintenance: we host your site free for 30 days after launch. By then, you can add Maintenance, or ask us to move your site to your own hosting account at no charge.
    • Reminders and handoff: we email you a reminder a week before day 30 and again on day 30. If by day 30 you have not added Maintenance or asked for the handoff, we email you the complete handoff package (all of your site’s files and instructions for moving it). We keep your site live on our hosting for 30 more days, then take it off our hosting. That is 60 days in total from launch. We always email you before we take it off our hosting.
    • Business and Enterprise packages: your first month of Maintenance, including hosting, is free. It does not renew by itself: before that month ends we ask you, and Maintenance continues at $99 per month only if you say yes; if you do not, the reminders and handoff above apply.
  • Domains. You register and own your domain name, in your own name and in an account you control, and you pay the domain registrar directly. Your package includes connecting your domain to your site.
  • Leaving. If you ever want to move your site elsewhere, we will move it to your own hosting account or give you a complete copy of its files and code. There is no handoff fee.

9. Third-party services

Your site may rely on outside services, such as your hosting platform, domain registrar, booking tools, payment processors, online stores, contact-form services, email services, maps, or analytics. For example: Stripe, Square, Shopify, and Google.

  • Those services have their own terms and fees, and you may need your own account with them.
  • We are not responsible for their outages, price changes, policy changes, or the way they handle data.
  • If a third-party service changes in a way that breaks part of your site, fixing it is billed as new work, and we will tell you the price before we start.

10. What we will not build

We reserve the right to refuse service to anyone. We may decline to build any website, or stop any project, at our own discretion.

We do not build websites for these kinds of business:

  • adult businesses: sex shops, pornography, and other adult entertainment;
  • gun and firearm stores;
  • cannabis businesses; or
  • any business or activity that is illegal or illicit.

We do not build sites that:

  • break any law, or help anyone else break one;
  • infringe anyone’s copyright, trademark, or other rights;
  • are false, misleading, defamatory, hateful, harassing, or sexually explicit;
  • collect protected health information (see section 5); or
  • are meant to spread malware, spam, or scams.

If we find out after payment that we will not build a project, we will stop work and handle the refund as our Refund and Cancellation Policy describes.

11. Warranties and disclaimers

We promise to do the work in a professional way, to deliver what your package describes, and to keep the delivery guarantee in section 4.

Apart from those promises, the website and our services are provided “as is.” To the fullest extent the law allows, we make no other promises, including promises about:

  • sales, leads, traffic, or search rankings;
  • your site being error-free or online without interruption; or
  • your site meeting a particular law or regulation that applies to your business.

Bug-fix window. If you find something we built that does not work within 30 days after launch, tell us and we will fix it at no charge. Problems caused by later changes made by you or someone else, or by third-party services, are not covered.

12. Limitation of liability

To the fullest extent the law allows:

  • Our total liability for any claim about our services is limited to the amount you paid us for the service the claim relates to.
  • We are not liable for indirect or consequential losses, such as lost profits, lost sales, lost data, or damage to reputation.

Some places do not allow some of these limits, so they may not all apply to you.

13. Your responsibility to us

If someone makes a claim against us because of material you supplied, or because of how you run your business or use your site, you agree to cover our reasonable costs of dealing with that claim.

14. Ending the agreement

  • Monthly plans: you can cancel any time, as our Refund and Cancellation Policy explains.
  • Packages: you can cancel a project at any stage. What you get back depends on the stage, as our Refund and Cancellation Policy explains.
  • By us: we may end a project or plan if you break these terms, do not pay, or ask us to build something section 10 excludes. If we end a project for a reason that is not your fault, you get a full refund. If we end it because you broke these terms, the refund follows the stage table in our Refund and Cancellation Policy.

Sections 7 (ownership, for work you have paid for), 11, 12, 13, and 16 still apply after the agreement ends.

15. Changes to these terms

We may update these terms. We will post the new version on this page with a new effective date. Changes never apply to a package or month you have already paid for. For monthly plans, we will email you at least 30 days before a change that affects you.

16. Governing law and disputes

These terms are governed by the laws of the State of California.

If we have a disagreement, please email us first. Most problems get solved faster that way. If we cannot solve it together, the dispute will be handled in the state or federal courts located in California.

17. Everything else

  • These terms, the package descriptions on our pricing page, our Privacy Policy, and our Refund and Cancellation Policy are the whole agreement between us.
  • If one part of these terms turns out to be unenforceable, the rest still applies.
  • If we do not enforce a term right away, we can still enforce it later.
  • You may not transfer this agreement to someone else without our written permission.

18. Contact

How fast we reply. We reply to your emails within 1 business day, except where these terms, our Privacy Policy, our Refund and Cancellation Policy, or our Accessibility Statement give a specific kind of request its own time (a Maintenance or Priority Maintenance request, a privacy request, a cancellation, or an accessibility report).
